Introduction
The RackList Ambassador program brings together volunteers who support the project, help spread the word, and contribute to community life. This charter sets out the framework of the program, the ambassador's commitments, what RackList provides in return, and the grounds for suspension or revocation. It complements without replacing the platform's Terms of Use and Privacy Policy.
This document is neither an employment contract nor a service agreement. Ambassador status is voluntary and revocable at any time, under the conditions described below.
Purpose
This charter defines the conditions under which a volunteer user (the "Ambassador") contributes to promoting, animating and growing the RackList platform, without compensation, on a strictly voluntary basis.
Definitions
- Program
- The RackList Ambassador program, as run by the publisher.
- Ambassador
- Natural person of legal age, holder of a verified RackList account, admitted to the program after express acceptance of this charter.
- Publisher
- Alexandre ETEOCLE, sole trader, publisher of the RackList platform and data controller under the GDPR.
- Platform
- The racklist.eu website and all its associated services.
Eligibility
To join the program, the candidate must, at the time of application and throughout the duration of membership:
- Hold an active, verified RackList account, compliant with the Terms of Use.
- Be a natural person of legal age under French law (18 years or older).
- Not be subject to any ongoing sanction on the platform (ban, restriction, multiple confirmed reports).
- Expressly accept this charter and its subsequent updates.
Ambassador Commitments
The Ambassador agrees, in the context of contributions made on behalf of the program, to:
- Disseminate accurate and verifiable information about RackList and the listed hosting providers, without misrepresenting features or terms of use.
- Maintain a respectful and professional tone in all public or private communications related to the program.
- Refrain from any spam, unsolicited canvassing, or manipulation of rankings and reviews.
- Not present themselves as an employee, agent or official representative of the publisher beyond the exact framework defined by this charter.
- Comply with the platform's Terms of Use and applicable French law, in particular review-loyalty obligations (French Consumer Code, art. L. 111-7-2).
Non-financial Counterparts
In return for the Ambassador's voluntary commitment, the publisher provides, without guarantee of permanence and on a revocable basis:
- A badge displayed on the public profile, identifying the Ambassador status.
- A communication kit (visuals, sample texts, FAQ) available from the Ambassador area.
- A personal referral link to track signups brought in by the Ambassador.
- A dashboard summarising the Ambassador's activity (clicks, signups, contributions).
- Early access to certain features in testing, subject to discretion.
Use of the RackList Brand
The Ambassador may mention the name and logo "RackList" only in the context of contributions to the program, and only using materials supplied by the publisher. Any use outside this scope, in particular for own commercial purposes, as a company name, domain name, registered trademark, or derived product, requires prior written authorisation from the publisher.
Transparency and Disclosure
When the Ambassador communicates publicly about RackList (social media, articles, videos, podcasts), they must clearly state their Ambassador status, in line with French Consumer Code art. L. 121-3 on misleading commercial practices and content-origin disclosure obligations.
Conflicts of Interest
The Ambassador agrees to disclose to the publisher any direct or indirect financial, ownership, or operational link with a hosting provider listed on the platform. The publisher reserves the right to restrict the Ambassador's actions concerning that provider (reviews, promotion, scoring) in order to preserve the impartiality of the listing.
Personal Data Protection
Processing of personal data carried out as part of the program is described in the Privacy Policy.
The Ambassador status (membership, tier, activity metadata) is retained for the entire duration of membership and up to three years after termination, for evidentiary and program-management purposes, on the basis of the publisher's legitimate interest (GDPR art. 6.1.f). The Ambassador has the rights of access, rectification, erasure, restriction and objection provided for in GDPR articles 15 to 22, exercisable at [email protected].
Voluntary Nature
Ambassador status is strictly voluntary. It does not entitle the Ambassador to any compensation, commission, indemnity, or other financial benefit from the publisher. The non-financial counterparts described in article 5 are neither compensation in kind nor wages.
This charter creates no legal subordination link between the publisher and the Ambassador, and cannot be recharacterised as an employment, apprenticeship, internship, or service contract.
Suspension
The publisher may suspend Ambassador status at any time, by motivated notice sent by email, in the event of a breach of this charter or of the Terms of Use. The suspension opens a grace period during which the Ambassador may submit observations. At the end of this period, the publisher either reinstates or revokes the status. During suspension, the badge, dashboard access and referral link are disabled.
Termination of Status
The Ambassador may waive their status at any time, without notice or reason, by email to [email protected] or via the Ambassador area. The publisher may revoke the status at any time, by motivated notice, notably in the event of a serious breach of commitments, prolonged inactivity, or program discontinuation. Termination, whatever its cause, results in the immediate loss of the badge, the referral link, and associated accesses.
Charter Updates
This charter may be modified by the publisher, in particular to reflect changes to the program, the platform, or applicable legislation. Updates are communicated to Ambassadors by email and publication of the updated version. Failing formal refusal within fifteen days, the changes are deemed accepted. In case of refusal, the Ambassador may waive their status under the conditions of article 12.
Governing Law and Jurisdiction
This charter is governed by French law. It is interpreted consistently with the platform's Terms of Use. Any dispute relating to its interpretation or performance is submitted to the competent courts of the publisher's place of business, subject to mandatory provisions applicable to consumers.
